The rules and guidelines governing your use of the Webnyxa AI Builder platform.

Website hosting on Webnyxa subdomains or custom domains
An interactive builder for editing and refining generated websites
Dashboard tools for managing sites, settings, and account

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for all activities that occur under your account. Webnyxa shall not be liable for any loss or damage arising from your failure to maintain the security of your account.

4. Acceptable Use

You agree not to use the Service to:

Generate, host, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Infringe on any third party's intellectual property rights, privacy, or other rights
Distribute malware, viruses, or any other harmful software
Attempt to gain unauthorized access to the Service, other accounts, or related systems
Use the Service for phishing, spam, or fraudulent activities
Violate any applicable local, national, or international law or regulation
Reverse engineer, decompile, or disassemble the Service or its underlying technology

We reserve the right to suspend or terminate your account if you violate these acceptable use guidelines.

5. AI-Generated Content

5.1 Nature of AI Output

The Service uses artificial intelligence to generate website content, code, and designs. AI-generated output may not always be accurate, complete, or error-free. You are responsible for reviewing and verifying all generated content before publishing.

5.2 Content Ownership

You retain ownership of the content generated through the Service using your inputs. Webnyxa does not claim ownership of your generated websites, text, images, or other content.

5.3 AI Disclaimer

Webnyxa does not guarantee the originality, accuracy, or legal compliance of AI-generated content. You are solely responsible for ensuring that your published content complies with applicable laws, including copyright, trademark, and privacy regulations.

6. Intellectual Property

6.1 Our Property

The Service, including its underlying technology, AI models, software, design, logos, and documentation, is the intellectual property of Webnyxa Technologies Pvt. Ltd. and is protected by applicable intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose, subject to these Terms.

6.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service may be used by Webnyxa without any obligation to you.

7. Payments & Subscriptions

7.1 Free & Paid Plans

The Service offers both free and paid subscription plans. Free plans have limited features and usage quotas. Paid plans unlock additional features, higher quotas, and priority access.

7.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase. All payments are processed securely through third-party payment providers (Razorpay, Stripe).

7.3 Price Changes

We reserve the right to change pricing at any time. Existing subscribers will be notified of any price changes before their next billing cycle.

8. Refund Policy

Due to the nature of digital services and AI-generated content, all purchases are generally non-refundable. However, we may consider refunds on a case-by-case basis under the following circumstances:

Service was completely unavailable for an extended period during your billing cycle
You were charged incorrectly due to a technical error
You cancel within 48 hours of your first paid subscription and have not used paid features extensively

9. Termination

9.1 By You

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will immediately cease.

9.2 By Us

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.

9.3 Effect of Termination

Upon termination, your websites may be taken offline and your data may be deleted after a reasonable retention period. We are not liable for any loss of data resulting from account termination.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
That the Service will be uninterrupted, error-free, or secure
That AI-generated content will be accurate, original, or free from legal issues
That the Service will meet your specific requirements

11. Limitation of Liability

To the maximum extent permitted by applicable law, Webnyxa Technologies Pvt. Ltd., its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

Your use of or inability to use the Service
Any AI-generated content created through the Service
Unauthorized access to your account or data
Any third-party conduct or content on the Service

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
